Ary and Phillips Cards and Collectibles

1. Overview

Welcome to Ary and Phillips Cards and Collectibles ("we," "us," or "our").

By accessing our website or purchasing merchandise, you agree to these Terms of Service and our published store policies.

Our ecommerce website operates through Shopify.

Nothing in these terms limits any consumer rights or remedies that cannot legally be excluded.

2. Products and Merchandise

We sell sports cards, trading cards, individual collectible cards, professionally graded cards, sealed trading card products, and related collectibles.

We make reasonable efforts to accurately describe and photograph our products.

Customers should review all product descriptions, available photographs, pricing information, and relevant policies before completing a purchase.

3. Trading Card Conditions and Grading

Raw trading cards are sold according to their photographs and descriptions.

Unless expressly stated otherwise, we do not guarantee any specific third-party grading result.

Differences in opinions regarding corners, centering, edges, surface quality, and overall condition do not automatically establish a product defect or misrepresentation.

Professionally graded cards are described according to their identified grading-company labels.

We do not guarantee that previously graded cards will receive equivalent grades if resubmitted.

4. Sealed Products and Randomized Contents

Trading card packs and boxes may contain randomized manufacturer-selected contents.

Unless specifically guaranteed in the product listing, we do not promise:

Particular players, teams, or characters.
Autographs or memorabilia cards.
Numbered cards, rare inserts, or parallels.
Specific grading results.
Particular financial or resale values.

Manufacturer-published odds, averages, and configurations do not necessarily guarantee the contents of an individual sealed box.

Dissatisfaction with randomized contents alone does not ordinarily qualify for a refund, subject to applicable law.

5. Pricing and Inventory

All prices are listed in United States dollars unless otherwise indicated.

Prices and inventory availability may change before an order is accepted.

We reserve the right to correct genuine pricing, listing, or inventory errors where permitted by law.

If an order is canceled because of an error or unavailable inventory, any collected payment for the unfulfilled merchandise will be refunded.

We will not increase the price of an accepted order without the customer's agreement.

6. Orders and Payment

Customers agree to provide accurate billing, payment, and shipping information.

Orders may be reviewed for fraud prevention, payment verification, and inventory availability.

We reserve the right to reject or cancel fraudulent or otherwise unlawful transactions.

Any legally required refunds will be issued in accordance with applicable consumer protection laws.

7. Shipping and Delivery

We currently ship within the United States only.

In-stock merchandise is generally processed and shipped within 1–3 business days after payment confirmation.

Business days exclude weekends and federal holidays.

Standard delivery generally takes approximately 3–7 business days after shipment, depending on the carrier and destination.

Delivery estimates are not guarantees unless expressly identified as such.

If we cannot ship merchandise within the promised timeframe, we will provide the applicable notice, cancellation options, and refunds required by law.

Customers are responsible for providing accurate shipping information.

Shipping and delivery disputes will be investigated using available records and handled in accordance with applicable law.

8. Returns and Refunds

Purchases are subject to our published Return and Refund Policy.

Trading cards are generally final sale, except where our policies or applicable law provide otherwise.

Customers are encouraged to review the return conditions before purchasing.

9. Preorders

Products identified as preorders are not immediately available for shipment.

Estimated release and fulfillment dates will be disclosed in the applicable product listings.

Manufacturer delays, product allocations, and cancellations may affect availability.

Customers will receive required notices and cancellation or refund options if shipment cannot occur within the applicable promised timeframe.

If an item becomes permanently unavailable and we cannot fulfill the order, we will refund the payment for that unfulfilled merchandise.

10. Fraud Prevention and Payment Disputes

We may use reasonable fraud-prevention procedures to protect customers and our business.

We may retain transaction information, order confirmations, shipping records, and customer correspondence as permitted by law.

If a payment dispute or chargeback is opened, we may submit legitimate transaction and fulfillment evidence to the payment processor.

Customers retain their lawful chargeback and payment-dispute rights.

We encourage customers to contact us directly so we can investigate problems promptly.

11. Promotions and Discount Codes

Discounts and promotions may be subject to product exclusions, expiration dates, quantity restrictions, or usage limits.

Promotional offers cannot be combined unless expressly permitted.

Fraudulent or abusive use of discounts may result in cancellation where legally permitted.

12. Intellectual Property

Our original store branding, photography, descriptions, graphics, and website content are protected by applicable intellectual property laws.

Unauthorized commercial reproduction is prohibited except where permitted by law.

Third-party trademarks, manufacturer names, sports team names, and other intellectual property belong to their respective owners.

Unless expressly stated otherwise, Ary and Phillips Cards and Collectibles is an independent retailer and is not affiliated with or endorsed by those rights holders.

13. Collectible Market Risks

Trading cards and collectibles are sold as merchandise rather than investment products.

We do not guarantee that any merchandise will increase in value, maintain its original value, or achieve a particular resale price.

Information about rarity, collectible value, or historical sales is provided for informational purposes.

14. Limitation of Liability

To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special, or consequential losses resulting from use of our website or products.

Nothing in these terms limits liability for fraud, willful misconduct, violations of applicable law, or other liability that cannot lawfully be excluded.
